Mulago National Referral Hospital (MNRH) has written to Kampala Capital City Authority (KCCA)requesting to halt the planned developments on land comprising plot 790, block 5, along Dwaliro road, found on Mulago hill.
This is after KCCA Director of Physical Planning Vincent Byendaimira offered a temporary development permission to M/s Maldes Advocates to remodel an existing structure on the said piece of land.
In a letter dated July 4, 2025, Mr Byendaimira, based on the M/s Maldes Advocates application that he purportedly received on July 2, 2025, and in reference to the consent judgment on Civil Suit No. 0200 of 2025.
‘Temporary Development Permission is hereby granted for remodelling an existing temporary structure located on Block 5, Plot 790 at Mulago, Kawempe Division,’ the letter reads in part.
The letter further stated that the development permission was limited within the boundaries of the Kibanja as defined in the survey report that was prepared by the Ministry of Lands, Housing and Urban Development (MLHUD) dated April 29, 2024. The letter further determined the scope and conditions of development, and among them included limiting the remodelling to the existing structure, including demolishing many portions encroaching on neighbouring properties, in accordance with the MLHUD survey report.
The development was also expected to meet all applicable Public Health and Structural Standards as required under the Public Health Act, Building Control Act, 2013, and Physical Planning Act, Cap 142. Other general conditions included KCCA not being held for any damages, injuries, or losses arising from these works, the permit being valid for 12 months from the date of issue, with an extension only to be granted upon a written request before expiry.
KCCA further required the developer to obtain a Building Permit before commencement of works in line with the Building Control Act 2023, among others. According to a September 23, 2025, letter signed by Dr John Sekabira, addressed to the director of physical planning at KCCA on behalf of the executive director, Mulago National Referral Hospital, Dr Sekabira said land under contention belonged to the hospital , having been acquired between 1996 and 1998 under the African Development Bank Project. ‘….there is no Kibanja holder on the land in question since all Bibanja holders at the time of acquisition were compensated and given vacant possession,’ the letter reads in part.
The letter also informed the director of physical planning, KCCA, that part of the land comprising Plot 790 is where a section of Dwaliro Road passes, and this section of the road was officially sanctioned by the hospital management at the time of acquisition. He requested the KCCA director of physical planning to halt any planned development activities by any third party on the said piece of land. The letter was also copied to the Solicitor General, Ministry of Justice and Constitutional Affairs, Permanent Secretary of Ministry of Health, Secretary of Uganda Land Commission, KCCA Executive Director, and Division Town Clerk- Kawempe.
