DOLE reminds NCR employers of pay rules for Nov. 16-18 holidays

The Department of Labor and Employment (Dole) has reminded employers to observe proper wage rules during the special non-working days on Nov. 16 to 18, declared in connection with the Philippines’ hosting of the 49th ASEAN Summit and Related Summits.

Under Labor Advisory No. 16, employees who do not work on the special non-working days will generally follow the ‘no work, no pay’ rule, unless a company policy or collective bargaining agreement provides otherwise.

Below are the complete pay rules:

An employee who will work on this day shall receive additional 30 percent of the basic wage on the first eight hours (basic wage x 130 percent)

An employee who will work more than eight hours on this day shall receive additional 30 percent of the hourly rate on said day (hourly rate of the basic wage x 130 percent x 130 percent x number of hours worked)

If an employee works on this day that also falls on their rest day, the employer shall pay an additional 50 percent of the basic wage on the first eight hours of work (basic wage x 150 percent)

For work done for more than eight hours on this day that also falls on the employees’ rest day, the employers shall pay an additional 30 percent of the hourly rate on said day (hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked)

The Dole noted that the pay rules ‘shall also apply to employees in alternative, flexible, and telecommuting work arrangements, without prejudice to their entitlement of other benefits under their respective company policy, practice, or collective bargaining agreement.
