The Supreme Administrative Court has agreed to rule on an appeal by National Broadcasting and Telecommunications Commission (NBTC) chairman Sarana Boonbaichaiyapruck in a dispute over his eligibility to hold the post.
The higher court also ordered expedited proceedings to look into the case, according to Dr Sarana’s secretary at the NBTC office.
The move followed a Central Administrative Court ruling on Sept 25 dismissing Dr Sarana’s lawsuit challenging a decision by the NBTC member selection committee that he lacked the required qualifications or possessed a prohibited characteristic under Section 8(2) of the NBTC Act.
The selection committee had also ruled Dr Sarana was deemed to have relinquished his right to assume office under Section 18 of the law.
The lower court upheld the legality of the committee’s decision and dismissed his lawsuit.
The NBTC chairman said he has evidence to contest allegations that he relinquished his rights, insisting he resigned from his previous positions before receiving royal appointment.
He is a physician, clinical professor and cardiologist by profession.
